Article 1 - Field of application

These current general terms of sale apply to all orders done on the internet site www.on-the-pipe.com with no restrictions or reserve.
The users must take knowledge of the whole general terms of sale and must accept them by checking off the checkbox. By accepting, the users give up showing up contradictory documents and especially its general terms of sale. The company Rider Zone has the right to modify at any moment the general terms of sale.
In case of modification, the current general terms of sale will be applied to each order at the date of the order.

Article 2 – Order

The users must only order from the references showing on the internet site. The products are sold only if they are available in stock. The validation date must correspond to the validation of the payment.
Prior to the validation of the payment and because of a high volume of unpaid orders, none of the products registered at the moment of the order will be reserved. Rider Zone will not guarantee their availability.
In case of unavailability of the product and no matter what the method of payment is Rider Zone undertakes to propose a similar product to a similar price or will give a credit within 30 days from the validation of the order. The refunding of sums of money improperly collected will be done if the error is at the fault of Rider Zone only and absolutely not in case of unavailability of the product at the reception of a delayed payment.
The prices are in Euros taxes included plus cost of delivery. Rider Zone can modify prices at any time. However, Rider Zone undertakes to apply the pricing in force shown when the order was taken (subject to availability at this date).
The users have to pay for the cost of delivery on top of the purchased price. The amount will show on the order form prior to the validation of this one.
All orders done on the internet site and delivered out of France will eventually be subject to taxes and/or customs rights requested by the state of destination.
These customs rights and other eventual taxes are chargeable to the customer and are under its responsibility.
The Company Rider Zone is not responsible for checking and informing the customer about these rights and taxes.
The entire payment has to be paid during the ordering online.
At any moment, the payment will be considered as a security deposit or an installment.

Article 3 – Methods of payment and security

Rider Zone undertakes to offer its customers methods of payment according to their zone of expedition.
by banking card:
The payment is made online by banking card VISA or Euro card MasterCard.
The information is coded by E-transaction of the Credit Agricole owning the protocol SSL 128 (Secure Socket Layer). The information cannot be read during their transfer into the network.
None of the banking information will forward via the website on-the-pipe.
The payment by banking card is absolutely secured and Rider Zone is not responsible for any difficulties of functioning that might occur online.
The order made online is registered and validated as soon as the payment has been accepted by our banking service.

by personal check: (not available for the customers out of Metropolitan France)
The customer will send a personal check to the order of Rider Zone to the following address:

The customer will join a printed confirmation of the order he received by email.
As indicated in article 2 of the current general terms of sale, Rider Zone cannot guarantee the availability of all products for the orders paid by check.
Furthermore, the payment by banking card speeds up the process of the order.

by PayPal:
All customers may choose this method of payment.
PayPal codes and secure the database and acts as a middleman to make the transactions.
Rider Zone is not responsible for any difficulties of functioning that might occur on the PayPal site.
The order will be registered and validated as soon as the receipt of confirmation has been sent by PayPal to Rider Zone.
As indicated in article 2 of the current general terms of sale Rider Zone cannot guarantee the availability of all products for the orders paid by delayed payment.

clause of the reserve of property:
The products remain the property of Rider Zone until the entire payment is received.
However, as soon as the delivery is done, the risks of the merchandises are transferred to the customer.

default of payment:
Rider Zone has the right to refuse to deliver or to complete an order for a customer who did not totally or partially pay a previous order or with whom there is a payment’s dispute in process.

Article 4 – Delivery

The expedition may vary from 2 to 5 working days for Metropolitan France, Corsica and Monaco only if the product is available (according to article 2).
The date of expedition may vary from 7 to 30 days for foreign countries if the product is available (according to article 2).
It is an average lead time depending on the destination, expedition and availability of the product.
Concerning the delivery, the general terms of sale depend on the type of expedition used:

France (post office):
Your order will be delivered in a registered letter max format or a Colissimo with a number to follow the package depending on the quantity delivered.

International:
You order will be delivered, either by Secur Export or International Collissimo depending on the quantity and the destination requested.
It will take 4 to 12 working days from the handling by the post office. The lead time of delivery are indicative and in working days. These are average lead times and may vary according to the destination.
Collissimo is given against a signature of the customer so it is preferable if the customer gives an address to which the order may be delivered at working hours.
The customer must give to Rider Zone its entire and exact address.
In case of an eroded or incomplete address of the customer, Rider Zone and the transporter could not be responsible.
The customer will take over the cost of re-expedition and if applicable the cost for reissuing an invoice of the lost goods.
The merchandises lost will not be refunded. The delivery may not be possible in case of unavoidable circumstances defined by a case law and in case of a strike from the post office or the transporter.
In case of an unusual delay an email will be sent to the customer.
In any case, the deliveries are made by subcontractors – the post office and no refund will be given by Rider Zone in case of delays,
In case of damaged package, or opened package the customer will have to refuse the package and immediately make a declaration of spoliation with the postman and immediately contact Rider Zone.
If this declaration is not rapidly received Rider Zone could not replace the order.
In case of the package returns to Rider Zone because of “unclaimed”, “refused” or “do not leave at this address” mentions Rider Zone will contact the customer and keep the package during a period of time of 15 days.
After this period of time has expired and without any news from the customer Rider Zone will issue a credit for the entire amount of the order (except cost of delivery).
If the delivery has not been received within 15 days the customer will contact the Company Rider Zone at +33 5 58 41 93 29.

Article 5 – Refunding

According to the article L121-20 of code of consumption the consumer has 7 calendar days to retract himself without any justifications or paying penalties, except the cost of return.
The consumer may derogate to this lead time in case he could not move or be in need of immediate service necessary for making its living. In that case only, the consumer will retract himself from the order without justifying or paying penalties.

The lead time of 7 days mentioned in the previous paragraph starts at reception of the goods. When the lead time of 7 days expires on a Saturday, Sunday, holiday or day off it is expanded to the next working day.
The shipping of the return must imperatively be done before the expiration of this lead time postmarked by the post office or the transporter.
In order to prove the date of the return the customer shall send the merchandises via a Colissimo with a tracking number or any kind of product from the post office as long it has a tracking number.
To make a return, you must contact us at +33 5 58 41 93 29 in order to receive an agreement of return.
Except an error or failure coming from Rider Zone or for all damaged products becoming unusable, the cost of re-expedition will be at the customer’s expense. Rider Zone does not accept any return in cash on delivery or carriage forward (in case of doubt, the customer may contact the Company).
The risks that may occur to the merchandises during the transport of the return will be at the expense of the customer even if the cost of the transport has been paid by Rider Zone. The return is only considered done at reception of the package in our store. The right of return cannot be done for the goods that might be reproduced (DVD, Video …) except if they returned not unsealed. The goods returned incomplete (without the original package), damaged or broken by the customer will not be taking back.
In case of abnormal or abusive return Rider Zone has the right to refuse a later order.

Article 6 – Guarantees

Independently of the commercial guarantee and according to the regulation Rider Zone undertakes to respect its obligation due to the guarantees of the products on its site showing in the articles from the code of consumption and the civil code like bellow:

commercial guarantee:
The length of guarantee may vary according to trademark or the product. It shows on the labels of the products. Some products are not under guarantee. The guarantee do not apply on the wear of certain parts of the product, on the consumables, in case of a bad use, cleaning default not even in case of a professional or collective use.
It is not applicable on damages caused by exterior causes on the material (lightning, flood, and storm).

intellectual property:
The use of the website is strictly reserved to a personal use.
All trademarks, texts, comments, works, illustrations, pictures, visuals or scores reproduced on the site www.on-the-pipe.com are protected as copyrights, branding, patenting and rights of images. They are the whole property of Rider Zone or its partners.
All reproduction or representation entirely or partially conducting to counterfeiting may engage the responsibility of the perpetrator.
Putting a link hypertext on the website Rider Zone by using the technical called “framing” or “deep linking” is strictly forbidden.

Article 7 – Confidentiality

Rider Zone undertakes to protect the private life of the persons who use its website and the confidentiality of the information given by the customer.
The information and the database concerning the users are necessary to the management of their order and for the commercial relationships.
Rider Zone undertakes to only use this information for its commercial activity.
These information and database are stored for security reasons in order to respect the legal and statutory obligations and to permit Rider Zone to improve and personalize their services to the attention of the customers.
According to the article 34 of the law of processing and freedom Rider Zone gives the right to access and the right of reply to personal data of its users and opposition of their processing. The customer may write online or send a mail to Rider Zone, 147 Avenue des Charpentiers, ZA Pedebert 40150 Soorts-Hossegor indicating its family name, first name, email address, mailing address and if possible its customer’ references.
According to the choice during the creation or consulting of an account the customers are susceptible to receive some special offers from the Company Rider Zone.
If the customer does not wish to receive the offers any longer they may make a request at any time.

Article 8 – Applicable rights

In case of dispute, we will always try to find a friendly solution versus a legal solution.
All relationships coming from the connection and/or the use of the current website are subject to French laws.
In case of dispute, the only competent jurisdiction is the courthouse of Dax (40).
